TERMS AND CONDITIONS

Know the terms before you travel.

Understand the terms that apply when using our website and booking travel services with Popular Travels & Tours.

Terms and Conditions

1. Preliminary provisions

These “Terms and Conditions” represent the terms on the basis of which Popular Travels SRL (hereinafter, for brevity: POPULAR) agrees to make the Services available via the platform accessible from the Site (as defined below).

POPULAR offers its Customers the opportunity to book and purchase, with the support of its collaborators/agents, through the website https://populartravels.it/ (the “Site”), air travel tickets (the “Services”).

Only Customers who have previously viewed and unconditionally accepted these general conditions as part of the process of completing their booking will be able to use the Services offered by POPULAR TRAVEL'S & TOUR'S and by third-party carrier companies (e.g. individual airlines) through this Site.

In the event that a Customer does not accept the general conditions, it will not be possible to complete the booking. These general conditions are in force from 01/11/2024.

Customers agree to fulfill the obligations set out in this document.

The contract between the Customer and the relevant third-party carrier companies comes into force as soon as POPULAR provides written confirmation of a booking to the Customer with the Booking Confirmation email.

Through the Site, POPULAR acts as an interface between the Customer and the third-party carrier companies that issue travel tickets, which remain the exclusive and direct suppliers of transport services.

These general conditions apply to the offering and provision of Services through this Site and incorporate all applicable rules and restrictions made available to the Customer before the booking is completed and which the Customer accepts at the time of booking.

It is the Customer's responsibility to read these "Terms and Conditions" and the Rules and Restrictions applicable by the individual third-party carrier companies. “Terms and Conditions” may be modified by POPULAR at any time without notice.

2. Definitions

The following definitions have the same meaning in the plural and singular.

The “Customer” is the person who books and/or purchases one or more Services offered on the Site.

“Fortuitous event or force majeure” means the circumstances outlined, described and specified in Article 8.

“Collaborators” are commercial operators with whom POPULAR has a collaborative relationship, including travel agencies not affiliated with IATA.

“POPULAR” is the company that provides the intermediation service for the purchase of airline tickets.

“Third-party carrier companies” means suppliers that issue travel tickets and provide transportation services, such as airlines.

“Rules and Restrictions” means the terms and conditions applicable to transportation services provided by third-party carrier companies (including, among others, the conditions of air transportation).

The term “Service” identifies any service offered on the Site, including the booking of travel services and the related payment management services, following direct access by the Customer to the Site or through the Collaborators.

“Site” refers to the web page located at: https://populartravels.it/.

3. The Customer's obligations

The Site provides travel services and operates as an interface in transactions carried out with third-party carrier companies.

The Customer must have the legal capacity to conclude contracts, at the time of booking, as well as the necessary authorization or power to act for or on behalf of each person included in a booking and must use the Services in compliance with these Terms and Conditions.

The Customer ensures and confirms that the details provided to the Collaborator in respect of all parts of the booking are complete and accurate and that all parties have agreed to be bound by these Terms and Conditions.

The Customer is responsible for the booking and must:

  • Verify the flight date and time and ensure payment of the purchase price of the Services.
  • Submit any request for modification or cancellation.
  • Pay any additional expenses relating to the booking.

The Customer agrees to verify all descriptions in the travel documents received after the booking and to immediately inform POPULAR in case of errors or other circumstances including cases where the personal details do not match those shown in the passports of those traveling under the booking.

The Customer is responsible for requests for Services also forwarded through collaborators/travel agencies through the Site.

The Customer guarantees the accuracy of the personal information they enter on the Site and, where applicable, of the information on the people traveling with them.

4. Payment of the price

The prices of the Services booked on the Site must be paid to POPULAR.

The Customer will make the payment through the systems made available to POPULAR, including any commissions applied, also in relation to currency conversion.

Subsequently, POPULAR will send the Customer an email confirming the booking.

The confirmation email contains a copy of the purchase details which remain available through the Site.

In the event that any data is not correctly reported or the Customer does not receive a confirmation email within 24 hours, the Customer is required to promptly contact the Customer Support Service without delay by email at ptt@populartravels.it or by telephone at +39 06 44704905.

If there are other problems, for example a transaction is not successful, or if a problem occurs during the booking, it could happen that, due to the current payment system regulated by the international credit card associations, amounts equal to all or part of the cost of the intended purchase are temporarily blocked on the Customer's credit card.

In this circumstance, POPULAR does not make any debit to the Customer's account.

The travel document will be issued and sent via email to the address indicated by the Customer within 24 hours following the acquisition of the payment by POPULAR.

Prices and fare conditions are subject to change without notice.

The Customer who has paid only the deposit for the seat reservation is warned that this amount does not refer to the overall cost of the travel ticket.

Although third-party carrier companies have the right to vary prices at any time up to the day of departure, this variation will be applied to the issuing of the ticket, in the case of a deposit paid at the time of booking.

This circumstance represents an exception since ticket issue prices are not normally subject to change.

For Customers who have paid only the deposit, any increase in price will be the subject of separate communication and POPULAR has no responsibility for the case of variations compared to the original price.

4.1 Information regarding the pricing currency

The prices and fares specified for some flights departing outside Italian territory may be subject to a different currency, for which POPULAR will provide an estimate in euros.

The actual amount charged by the airline may vary slightly due to fluctuations in exchange rates applied by different credit card issuers.

Furthermore, the Customer's account statement may include a fee applied by the credit card issuer for processing the transaction in a currency other than euros.

POPULAR will not be in any way responsible for charges relating to changes in exchange rates and commissions applied by each credit card issuer.

4.2 Prices and information on the Site

The price of the Services will be that indicated from time to time on the Site, except in the case of manifest material error. All applicable taxes and fees are included in the price.

Some airlines may request surcharges for additional baggage and/or other increases.

However, the purchased fare is not guaranteed until the price has been paid.

Tickets purchased at discounted and/or low-cost rates are not refundable or changeable, unless otherwise expressly provided. Therefore, it is the Customer's responsibility to ensure that the purchased ticket can be changed.

Prices are subject to updates at any time; however, these changes will not affect bookings already accepted, except those for which the Customer has paid a mere advance to block the booking.

If the Customer, after having paid only the deposit for the booking, does not proceed with the balance for the purchase of the ticket and the same has already been issued, POPULAR will withhold from said deposit the penalty payable by the Customer foreseen by the company, without prejudice to the additional credit.

Although POPULAR undertakes to do its best to avoid errors, the price of some Services indicated on the Site may not be correct.

POPULAR reserves the right to correct any manifest material error on the price, on the site and/or with respect to reservations made at the incorrectly indicated price.

In such cases, when possible, POPULAR will offer the Customer the opportunity to choose between keeping their reservation at the correct price or canceling the reservation without penalty for the Customer.

POPULAR is in no way obliged to provide the Services to the Customer at a lower price incorrectly indicated, even after the Customer has sent the booking confirmation.

5. Modification of the reservation

In the event of a request to modify the booking by the Customer, POPULAR will proceed, in the name and on behalf of the Customer, according to the following conditions:

Changing the booking, on tickets with limitations, may result in the application of penalties to be paid by the Customer, without prejudice to any additional price to be paid if due.

Changing the booking, on tickets without limitations, does not entail the application of penalties but only the payment of any higher price of the new ticket, including all costs, taxes and tariffs applied by the carrier.

Booking changes can also be requested more than once provided that this is permitted by the travel policies in use by the selected carrier.

In any case, POPULAR will apply a commission for the booking modification service, equal to €25 for each ticket and whenever the modification is requested if possible.

If, upon rebooking, the rate applied by the carrier is lower than the price already paid, including taxes and charges, POPULAR will not refund the Customer any difference.

The Customer may contact Customer Support by email at ptt@populartravels.it or by telephone at +39 06 44704905.

6. Cancellations and refunds

The Customer is informed that the cancellation of the ticket is bound to the relevant policies adopted by the single chosen air carrier.

Ticket cancellation is subject to the following conditions:

The cancellation of tickets with limitations may result in the application of penalties to be paid by the Customer;

The cancellation of tickets without limitations may not entail the application of penalties;

In any case, POPULAR will apply a fee for the cancellation service, equal to €30, for each canceled ticket, a sum that POPULAR will deduct from the sum refunded to the Customer.

The refund request is sent by POPULAR, in the name and on behalf of the Customer, to the carrier and is subject to processing times according to the policy of the chosen airline, as well as the amount of the sums due net of penalties and the methods of crediting the refunds themselves.

The refund procedure, once activated, is intended to be defined within a purely indicative term which varies between 6 and 10 weeks.

7. Conditions of air carriage

The Customer is recommended to check in at least three hours before departure in the case of international flights and at least two hours before departure in the case of domestic flights.

Furthermore, the Customer is advised to allow sufficient time in case there should be delays for journeys involving connections, in particular when a transfer to another airport is necessary.

POPULAR recommends that customers with particular seating requirements check in early.

It is the Customer's responsibility to comply with the instructions of the airline and any other supplier, in particular, regarding flight check-in times.

In particular, the Customer is aware and accepts that:

POPULAR has no control over seat assignments, even if booked in advance with the airline, and does not guarantee that specific seats will be available upon departure;

POPULAR has no control over any indication of flight time indicated by the third-party air service provider. This information is intended as indicative and subject to modification and confirmation. Flight times use the 24 hour system and departures are based on the time zone of the flight location and may vary depending on flight listings, aircraft type, weather conditions, etc. Any indication of the hours spent in flight includes the time spent on the ground during stops en route or for connections with other flights; therefore, these indications serve only as a guide and may be subject to changes and confirmations;

You may need to confirm your return flight with the airline (no later than 72 hours before your scheduled flight date). It is the Customer's responsibility to confirm their return travel in accordance with the terms of the third-party air service provider. In the case of open air tickets, seats are subject to availability and it is advisable to book the return flight as soon as possible;

In the event that the Customer books a return trip and does not use the departure trip, the airline may cancel the return trip without paying any refund. This may happen even if the return flight is not used or even if the entire trip is not used. The Customer must use the coupons for sequential flights;

In the case of special or charter flights, the name of the airline, the expected time, the type of aircraft, the itinerary and possible intermediate stops are to be understood as indicative of the outward and return flights during the trip. In accordance with the applicable Rules and Restrictions, such flights, aircraft types and flight numbers may be subject to change and may be postponed for up to 24 hours, even without confirmation;

Additional costs may be imposed by some airlines for meals, baggage, seat selection, etc. POPULAR is not responsible for these additional costs and the information on them contained on the Site is provided as simple indications and may be modified by the airline at any time;

The Customer must comply with all applicable Rules and Restrictions relating to pregnant women. In particular, the Customer is reminded that airlines may reserve the right to refuse to board pregnant women if, based on their assessment, the advanced state of pregnancy may entail the risk of a premature birth during the flight;

The Customer must comply with all applicable Rules and Restrictions relating to the transport of children and in particular that children over 2 years of age on the return date must have a return ticket at a child rate for both the outward and return flights. Customers who do not comply with this requirement will not be entitled to refunds for additional seat costs incurred during the trip. Children under the age of 2 will not have an assigned seat on the aircraft unless a child fare has been booked for them;

Unaccompanied minors under the age of 14 will be accepted for carriage only in accordance with the applicable Rules and Restrictions;

In the event that the trip involves stopovers in multiple airports, it is the Customer's responsibility to organize the relevant transfers and verify possession of any required transit permits and visas;

If the journey involves transit in different terminals, it is the Customer's responsibility to request a visa for the passage between the terminals, contacting, if necessary, the relevant embassy or the carrier directly to verify possession of a suitable qualification for the passage between terminals.

For further advice on preparing for a flight, please contact Customer Service.

7.1 Travel documents

The travel documents necessary for a Service requested through the Site will be sent to the email address provided by the Customer at the time of booking.

POPULAR or third-party carrier companies cannot be held responsible if the delivery or provision of travel documents proves impossible due to an error made by the Customer in providing their personal data or email address.

7.2 Passports, visas, administrative and/or health regulations

In the case of international travel: the Customer is responsible for complying with the requirements necessary to enter a foreign country and that travel documents, such as passports and visas (for transit, for commercial purposes, as tourists, etc.) are valid and for all the requirements required by the foreign country to enter.

POPULAR does not have specific knowledge of the entry requirements required by foreign states or travel documents nor is it obliged to provide specific information in this regard.

The Customer is therefore recommended to inform themselves about the prohibitions, notices, announcements and advice provided by the competent administrations of the various foreign countries.

As for health rules, the vaccinations recommended for the trip may vary, therefore the Customer is advised to consult their doctor before departure, being responsible for compliance with the health requirements necessary to enter the foreign country, taking care to carry out the suggested vaccinations and respecting the other medical and health suggestions relating to the trip. Health information for those intending to travel can be consulted on the site http://www.viaggiaresicuri.it/.

From an administrative point of view, some States have immigration policies such that the passport is valid for a minimum period after the Customer's entry into the territory of that country, typically equal to 6 months.

If a Customer's passport is in its last year of validity, the Customer is advised to check the destination requirement before making final travel plans.

The name in the passport must match the name on the ticket, otherwise the Customer will not be able to travel.

Please note: It may take some time to obtain a visa; therefore, Customers are advised to apply well in advance. Visa requirements may vary, so Customers should update themselves on any changes to visa requirements before booking and commencing their trip.

POPULAR cannot be held responsible in the event that the Customer is prevented from boarding or entering a foreign country due to the lack or invalidity of the passport, visas or other travel documents required by the airline, by the Authorities, by the foreign country including the countries in which the Customer will have to stopover. Information in this regard can be consulted on the website http://www.viaggiaresicuri.it/.

All reasonable losses suffered by POPULAR due to the Customer's failure to comply with these rules will be charged to the Customer.

While most trips, including trips to international destinations, end without incident, travel to certain destinations may pose a greater risk than others. POPULAR invites passengers to check and take into consideration any travel ban, warning, announcement or communication issued by national or international authorities before booking travel to international destinations.

Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be checked at http://www.viaggiaresicuri.it/.

The offer of tourist services in certain international destinations does not mean that POPULAR states or guarantees that traveling to those destinations is advisable or risk-free.

All travelers wishing to enter or transit through the USA under the Visa Waiver Program (VWP) will need to apply for travel authorization using the Electronic System for Travel Authorization (ESTA).

You must allow sufficient time (at least 72 hours before departure) to submit an ESTA authorization request.

For further information, please visit the United States Department of Homeland Security website at https://esta.cbp.dhs.gov.

Some countries are introducing new requirements for air carriers in relation to the provision of personal information regarding all travelers carried on their aircraft.

The data will be collected when the Customer checks in at the airport or, in certain circumstances, when the Customer makes the booking.

Consequently, the Customer is advised to allow more time to check in for their flight.

7.3 Responsibility

The liability of third-party carriers for death, personal injury and other damages is normally limited by national law, international transportation treaties, or the airline's Rules and Restrictions, including conditions of carriage.

7.4 Electronic ticket

An electronic ticket is a ticket in non-paper format.

The Customer who uses this ticket, except in cases where online check-in is permitted, must go to the check-in desk of the relevant airline and show a valid travel document (passport, visa, identity card, etc.) in order to receive their boarding pass.

The Customer must strictly observe the check-in times.

7.5 Third party carrier companies

Customers are advised that in some cases flights booked with one airline may be operated by another airline - the details of the operating airline, where different, will be indicated on the site. The airline providing the flight will charge the cost of the flight to the Customer and will appear as the seller on the Customer's credit card or bank statement. Payment may also be charged by other third-party suppliers for the Services booked; however, the total cost charged will not exceed the total price of the Service.

7.6 Compensation for missed boarding

The airline may provide compensatory remedies in favor of the Customer if it cancels or delays a flight, is unable to provide previously confirmed space, fails to stop at a stopover or final destination of a Customer, or causes the Customer to miss a connection that the Customer had booked.

8. Fortuitous event and force majeure

In these “Terms and Conditions”, when we refer to fortuitous events and force majeure we mean a situation which is beyond the control of the party invoking such situation and the consequences of which could not be avoided even by taking all reasonable measures.

This could include for example war, other serious security issues such as terrorism, significant risks to human health such as the outbreak of a serious disease at the destination, or natural disasters such as floods, earthquakes or weather conditions that make safe travel to the destination impossible.

9. Insurance

The prices indicated on the Site do not include travel insurance.

10. Customer service and complaints management

The Customer who intends to lodge a complaint must forward it exclusively by email to ptt@populartravels.it, within a period not exceeding ten days from the end of the trip.

Events such as the loss, theft, damage or late delivery of passengers' luggage or personal effects cannot be the subject of a complaint, as they are the direct responsibility of the carrier.

11. Responsibility

In relation to the purchase of the Services, POPULAR operates as an intermediary between the Customer and the Travel Service Provider and, therefore, POPULAR (even if it charges the price) will not be responsible for the failure of the Travel Service Providers to fulfill the obligations relating to the Services provided to the Customer.

Travel Service Providers provide POPULAR with information describing the services indicated on the POPULAR Site.

POPULAR will not be responsible for any inaccuracies relating to the information, except and solely to the extent that it is not directly responsible for such inaccuracies.

12. The right of withdrawal

Pursuant to the combined provisions of articles 47 letter g) and m) and 59 paragraph 1 letter n) of the Consumer Code, the right of withdrawal provided for by articles 52 et seq. of the Consumer Code does not apply.

13. Applicable law

These general conditions are governed by Italian law, excluding the applicability of law 218/95 ("Reform of the Italian system of private international law").

The Customer agrees that the Italian judicial authority will have jurisdiction in relation to any dispute arising from the interpretation and/or deriving from these "Terms and Conditions".

The European Commission provides a platform for the alternative out-of-court resolution of the same, accessible on the website http://ec.europa.eu/odr, which can be contacted in the event of disputes arising from these Terms and Conditions.

14. Final provisions

Should the competent judicial authority deem any provision, or part thereof, of these "Terms and Conditions" to be invalid, illegal or unenforceable, that provision, or part thereof, cannot be considered part of this contract with the Customer to the extent requested and the other provisions will remain applicable.

Any case of force majeure, including the interruption of the means of communication or a strike of carriers, hoteliers or air traffic controllers, will determine the suspension of the obligations contained in these "Terms and Conditions" which are affected by the force majeure event and the party affected by the force majeure event will not be responsible for the impossibility of fulfilling these obligations.
